Reckless driving is a serious offense in Pennsylvania and can carry severe penalties including the suspension of your license, large fines, and possible incarceration.
Pennsylvania law differentiates between reckless driving and careless driving.
Pennsylvania Vehicle Code Section 3736 defines a reckless driver as “any person who drives any vehicle in willful or wanton disregard for the safety of persons or property…”. Consequently, many actions may qualify as reckless driving in Pennsylvania. Some actions that are often cited as reckless driving include speeding, failure to obey traffic signals, unsafe changing of lanes, illegal maneuvers, and following too closely or tailgating.
By contrast, careless driving is defined in Pennsylvania Vehicle Code Section 3714, as “careless disregard” for public safety. The biggest distinction between reckless and careless driving is reckless is when the driver makes a more deliberate, conscious decision. Careless driving is when a driver is less deliberate or conscious in their action. A common example of careless driving is falling asleep at the wheel.
Convictions for reckless driving in Pennsylvania include a minimum fine of $200 and suspension of your license for a minimum of six months. Additionally, the Pennsylvania Department of Transportation can add points to your driving record when you are convicted of a traffic offense. If your reckless driving leads to an accident, there are more severe and harsh penalties. If there is bodily injury involved, the penalties are even more greatly enhanced.
