Historically, in Virginia, it was impossible to seal or expunge a conviction. That all has changed. Starting July 1, 2026 Virginia law allows sealing and expungement of certain convictions. The new Virginia law allows sealing of most misdemeanor convictions (other than DUIs) and even some class 5 and 6 felonies. Some minor convictions may be automatically sealed, although most will require a petition be filed, and a possible court date.
Generally speaking, for a misdemeanor conviction to be eligible for sealing, 7 years must have elapsed from the date of the conviction, and you must not have had any subsequent convictions.. For a Class 5 or 6 felony, generally 10 years must have elapsed from the date of the conviction, with no subsequent convictions. This process is distinct from gun rights restoration (which we also may be able to help with).
